App refers to any downloadable application owned or operated by Peak Medical including all features and content within it. 

Content refers to all information, videos, text, photos and other material provided through the Services. 

Services refers to all Apps, Websites, Content, software and tools provided or made available by Peak Medical. 

Users refers to all persons who access or use the Services. 

Website refers to any website owned or operated by Peak Medical including https://peakmedical.ai

2. Compliance with the Australian Privacy Act

Peak Medical collects, uses, stores and discloses personal information in compliance with the Privacy Act 1988 (Cth) including the Australian Privacy Principles. These principles govern: 

- The types of personal information we can collect 

- How personal information must be collected 

- How personal information may be used and disclosed 

- How personal information must be stored and secured 

- Your rights to access and correct your personal information 

 

Peak Medical is committed to full compliance with these obligations. 

3. Communications About Your Health

By signing up for the App or Services, you consent to receiving communications about your health, progress and support needs via email, push notification, mail, text message or phone call. 

You may update your communication preferences by contacting support@peak-med.com.

If you receive Peak Medical services through an employer or employer health plan:  

- We will not share any identifiable health information with your employer.

- We may provide de-identified or aggregated information for reporting or billing purposes. 

 

If you receive services through a healthcare provider or care team, we may share necessary identifiable information with those providers to support your clinical care. 

4. How We Collect Information

4.1 Information You Provide 

We collect personal information you provide when you:

- Register for the App 

- Create or update your profile 

- Submit health information or progress updates 

- Respond to surveys 

- Contact us or request support 

 

We do not request sensitive information such as government identifiers except where required for payment processing. Please avoid sending sensitive information by email or unsecured channels. 
 

4.2 Information Collected Automatically 

When you use our Services, we automatically collect technical information including: 

- Device type and identifiers 

- IP address 

- Browser type and settings 

- Time zone 

- Pages viewed and interaction behaviour 

- URL clickstream 

- Cookies and analytic data 

 

This information helps us maintain, secure and improve the Services.

4.3 Information From Third Parties

We may combine information you provide with information obtained from: 

- Analytics providers 

- Clinical partners 

- Technical service providers 

 

Third parties may independently collect information when you use our Services. Please adjust your device or browser settings to reduce third party tracking if desired. 

5. Video Recording in the Peak Medical App

The App may include optional video recording of exercise sessions. This feature is activated only with your explicit consent during setup.  

 

- You may stop recording at any time. 

- No other person should appear in recordings unless they also consent. 

- Recordings are used to support your care and to improve model accuracy. 

 

Recordings may be used for: 

- Annotation of movement and pose data 

- Training and validation of machine learning models 

- Optional sharing with your approved care team 

 

Recordings are encrypted during transmission and stored video is only accessible by authorised personnel and approved healthcare providers where applicable. Video recordings and associated personal information are retained only for as long as necessary to support your care or to meet applicable legal, contractual and regulatory obligations, after which they are securely deleted or de-identified in accordance with our Data Management Policy.

6. How We Use Personal Information

We may use your personal information to:

- Provide, maintain and improve the Services 

- Support your clinical care journey 

- Manage your account and send service-related communications 

- Generate aggregated statistical reports 

- Conduct research, testing and analytics 

- Ensure security and prevent unauthorised access 

- Meet legal, regulatory or contractual obligations 

- Notify you of changes to the Services 

 

We use personal information only for purposes permitted under the Australian Privacy Principles. 

7. How We Disclose Personal Information 

Peak Medical will not sell your personal information.

- Service providers who assist in delivering the Services (such as hosting, analytics, communication tools) 

- Your approved healthcare providers or care team 

- Our related entities and contractors 

- A purchaser of our business assets if required

We will respond to access or correction requests within a reasonable timeframe as required by the Australian Privacy Principles. 

9.1 Data Deletion Requests 

If you wish to delete your Bibo account and associated personal information, please submit your request to support@peak-med.com.

To help us process your request, please include:

- Your full name; 

- The email address associated with your Bibo account; and 

- A brief description of your request. 

To protect your privacy and security, we may ask you to verify your identity before processing your request. Once your identity has been verified, we will assess your request and delete or de-identify personal information that is no longer required for the purposes for which it was collected. 

Certain information may be retained where required by applicable laws, regulatory requirements, contractual obligations or our Data Management Policy, including medical device, clinical, financial and legal record-keeping requirements. 

At the end of the applicable retention period, retained personal information will be securely deleted or de-identified in accordance with the Australian Privacy Principles. 

We will notify you once your request has been completed. 

10. Security of Your Information 

Peak Medical uses appropriate administrative, technical and physical safeguards to protect personal information against loss, misuse, unauthorised access, alteration and disclosure. 

This includes:

- encryption of personal information in transit and at rest where applicable; 

- role-based access controls; 

- secure cloud hosting; 

- audit logging and monitoring; 

- regular security reviews; and 

- secure disposal of personal information when it is no longer required.

Personal information is retained only for as long as necessary to fulfil business, legal, regulatory and contractual obligations. When personal information is no longer required, it is securely deleted in accordance with our Data Management Policy. Where there is a legitimate purpose to retain information for research, analytics or regulatory purposes, the information will first be de-identified before being retained, in accordance with applicable laws and the Australian Privacy

Principles.

 

While we implement industry-standard safeguards, no method of electronic transmission or storage is completely secure.  

11. Children 

Our Services are intended for persons aged 18 years or older. We do not knowingly collect personal information from anyone under 18. If such information is identified, it will be deleted and the associated account closed. 

12. Third Party Links 

Our Services may contain links to websites operated by third parties. These websites have their own privacy policies and are not governed by this Policy. We recommend reviewing the privacy policy of any external website you visit. 

13. Changes to This Privacy Policy
